As homebrew games for unconventional platforms becomes more prevalent, we're going to start seeing a lot more of these cases, and there is an interesting marketing side to them as well as a legal side.

No lawyer am I, but it seems fairly clear that from a legal standpoint, games like Scrabulous are in a pretty weak position. The IP influence is very clear (and in this case, so is the licensing rights).

The real question, IMHO, is whether Hasbro and EA tried an alternative route before going with the legal option. Scrabulous is extremely popular; wouldn't it have made more sense (and required less money) to try and co-opt the game and re-brand it officially? The programmers apparently make no revenue from their association with the game, so I have to wonder how they got to this point?

Certainly, more info will come out over the next few months, but I have to wonder if Hasbro and EA missed a chance to solve the problem is a much quicker and high-minded fashion.

UPDATE: My god, what Christine de Pizanis wearing.... I'm not sure if that's technically ironic, but it is absurdly funny.

And they're not even bothering to name Edward III and Philip VI. They're just "King of England" and "King of France"...
